These Terms and Conditions (“Terms”) govern the use of international card payment services provided by the Center for Strategy and Cultural Diplomacy (CSCD), a social enterprise organization based in Pakistan, Indonesia with a sub-office in the United States. By using our website (www.thecscd.org) or participating in our events, programs, or services that involve international card payments (e.g., via third-party providers like Stripe, PayPal, Xendit or Eventbrite), you (“User” or “Participant”) agree to these Terms. These Terms are designed to synchronize with relevant e-commerce and payment regulations in Indonesia (e.g., Government Regulation No. 80/2019 on E-Commerce, Bank Indonesia regulations on payment systems, and Consumer Protection Law No. 8/1999) and Pakistan (e.g., Payment Systems and Electronic Fund Transfers Act 2007, Electronic Transactions Ordinance 2002, and provincial Consumer Protection Acts like Punjab’s 2005 Act). Where conflicts arise, the stricter standard applies to ensure compliance in both jurisdictions.

1. Eligibility and Registration

  • To use international card services, you must be at least 18 years old (or the age of majority in your jurisdiction) and provide accurate personal information during registration or payment.
  • CSCD reserves the right to verify your identity and payment details to comply with anti-money laundering laws in Pakistan (State Bank of Pakistan guidelines) and Indonesia (Financial Services Authority/OJK regulations).
  • For Indonesian users: Registration implies consent under Indonesia’s Personal Data Protection Law (UU PDP 2022) for data processing.
  • For Pakistani users: Compliance with the Federal Board of Revenue (FBR) requirements for digital transactions.

2. Payment Processing

  • CSCD uses third-party payment gateways (e.g., Stripe, PayPa, Xendit) to process international card payments (Visa, Mastercard, Amex etc.). These services are subject to their own terms, which you must review.
  • Payments may involve currency conversion; rates are set by the gateway and include applicable fees (1-3% markup per Indonesian and Pakistani banking norms).
  • International transactions are enabled only after activation via your card issuer. CSCD is not liable for declined transactions due to your bank’s restrictions (e.g., international usage limits in Pakistan or Indonesia).
  • Synchronization: In line with Indonesia’s QRIS and Bank Indonesia rules, and Pakistan’s SBP Raast/PayPak systems, we prioritize secure, PCI DSS-compliant processing. Cross-border payments comply with de minimis thresholds (e.g., up to PKR 5,000 in Pakistan for low-value imports; similar in Indonesia for small transactions).

3. Fees and Taxes

  • Application or registration fees are non-refundable unless specified otherwise (aligning with both countries’ consumer laws prohibiting unfair non-refundable clauses for faulty services).
  • Taxes: Indonesian users pay VAT (11%) if applicable under Law No. 7/2021; Pakistani users pay sales tax per FBR rules (up to 17%). CSCD reports taxes as required.
  • Synchronization: Fees are transparently disclosed to meet Indonesia’s e-commerce disclosure requirements (GR 80/2019) and Pakistan’s e-Commerce Policy 2.0 (2025-30) emphasis on fair pricing.

4. Electronic Contracts and Transactions

  • All agreements (e.g., event registrations) are electronic and binding under Indonesia’s Electronic Information and Transactions Law (UU ITE) and Pakistan’s Electronic Transactions Ordinance 2002.
  • You consent to electronic signatures and records.
  • Synchronization: Terms include clear identities, specifications, prices, and cancellation procedures, as mandated in both jurisdictions for B2B/B2C e-commerce.

5. Data Privacy and Security

  • CSCD complies with Indonesia’s UU PDP and Pakistan’s Personal Data Protection Act 2023 for data collection, use, and sharing.
  • We use safeguards like encryption; however, CSCD is not liable for cyberattacks (as per original policy, synchronized with both countries’ limitations on liability for force majeure).
  • Synchronization: Aggregated data sharing with affiliates is allowed, but personal data requires consent, aligning with GDPR-like standards in Indonesia and provincial privacy rules in Pakistan.

6. Liability and Dispute Resolution

  • CSCD is not liable for losses from third-party services, event changes, or user errors, per consumer protection limits in both countries.
  • Disputes: Governed by Pakistani law for Pakistan-based users; Indonesian law for Indonesia-based users. Arbitration in respective countries or via mutual agreement.
  • Synchronization: Incorporates fair dispute mechanisms from Pakistan’s e-Commerce Policy (platform liability for redress) and Indonesia’s consumer complaint frameworks.

7. Amendments and Governing Law

  • CSCD may update these Terms with notice; continued use implies acceptance.
  • Synchronization: Dual compliance ensures enforceability in cross-border scenarios, with severability clauses if provisions conflict with local laws.

Return and Refund Policy for Enabling International Card Services

This Return and Refund Policy (“Policy”) applies to payments made via international cards for CSCD’s services, events, or products. It synchronizes requirements from Indonesian law (Consumer Protection Law No. 8/1999, GR 80/2019 on E-Commerce) and Pakistani law (provincial Consumer Protection Acts, e-Commerce Policy 2.0 emphasizing enforceable refunds, and SBP guidelines for digital payments). Refunds are processed through original payment methods, subject to gateway terms. CSCD aims for fairness while adhering to non-refundable norms for certain fees in both jurisdictions.

1. General Refund Eligibility

  • Non-Refundable Items: Application fees, fully/partially funded delegate registrations, and discounted fees are non-refundable (as per original CSCD policy, compliant with both countries’ allowances for clear disclosure of non-refundable terms).
  • Eligible Refunds: Available for defective services/products (e.g., event cancellation by CSCD, faulty digital materials) or misrepresentation, per consumer rights in Indonesia (right to redress for defects) and Pakistan (entitlement for faulty goods under Consumer Protection Acts).
  • No refunds for “change of mind,” no-shows, or user-initiated cancellations unless specified.
  • Synchronization: Aligns with Indonesia’s prohibition on clauses denying refunds for defects (UU 8/1999 Art. 18) and Pakistan’s push for clear refund timelines in e-Commerce Policy 2.0.

2. Refund Conditions for Self-Funded Delegates

  • Full Participation Fee: Eligible for credit vouchers (not cash) if requested 30+ days before event; 50% fee if 25 days; 75% if 15 days; 100% retention if <15 days/no-show.
  • Discounted Fees: Non-refundable/non-transferable.
  • Synchronization: Vouchers valid for 1 year, non-transferable, no cash value—mirroring Indonesia’s flexible redress options and Pakistan’s emphasis on platform-enforced returns.

3. Return Process for Products/Services

  • Defective Items: Return within 7 days (Pakistan standard) or 14 days (Indonesian consumer norm) with proof. CSCD will repair, replace, or refund (voucher or cash if required by law).
  • Events: If CSCD cancels/alters (force majeure), vouchers issued; no liability for travel/losses (synchronized with both countries’ liability limits).
  • Digital Products: Non-returnable unless defective; refunds within 7 days if proven faulty.
  • Synchronization: Incorporates Indonesia’s requirements for hidden defects (right to return/replace) and Pakistan’s guidelines for online dispute resolution.

4. Refund Request Procedure

  • Email contact@thecscd.org with “Refund Request – [Service/Event Name]”, including name, order number, reason, and evidence.
  • Processing: 4-8 weeks (aligning with Pakistani banking timelines and Indonesian OJK standards); international cards may incur conversion fees.
  • Synchronization: Case-by-case review for special circumstances (e.g., force majeure), as per both jurisdictions’ consumer laws.

5. Exclusions and Limitations

  • No refunds for resold/transferred items without consent.
  • CSCD reserves rights to deny abusive requests, per anti-fraud rules in both countries.
  • Synchronization: Policy disclosed upfront to meet transparency mandates in Indonesia (GR 80/2019) and Pakistan (e-Commerce Policy 2.0).
